Biography

Carolyn Batz McGee practices primarily in the federal courts, though she has extensive experience in various district courts and in the Court of Appeals for the Third Circuit.  Her intimate knowledge and appreciation of the federal court system developed throughout her federal clerkship, for which she was hired out of law school, to the Honorable Nora Barry Fischer.  The majority of her current caseload involves defending mid-size and large manufacturers of home goods and medical devices against claims of strict liability, implied and express warranty, negligence, and breach of contract.  She also assists with the defense of one of the country's top five largest homebuilders against various state and federal claims.

Representative Matters

  • In early 2015 Carolyn won her first non-jury trial as first chair in state court in which her client, a residential home repair contractor, succeeded on a claim to recover fees for its completed work.  The defendants refused to make payment, arguing that the work performed was deficient.  Carolyn successfully defended against those claims in succeeding at trial.
  • Carolyn is an integral part of the litigation team currently defending a local global supplier of paints, coatings, glass and fiber glass in an environmental suit under the Clean Water Act and the Resource Conservation and Recovery Act.  She has taken several fact and expert depositions in preparation for trial.
  • Carolyn currently provides local counsel defense in several matters on behalf of a large manufacturer of medical devices in both the Western District of Pennsylvania and state court.  This defense has recently prompted her assistance with briefing on the changing landscape in Pennsylvania products liability law as a result of the Supreme Court's decision in Tincher v. Omega Flex., Inc., 2014 WL 6474923 (pa. Nov. 19, 2014).
  • Carolyn is currently defending a complicated litigation matter on behalf of a large homebuilder involving claims for negligence and product liability as a result of an explosion caused by an alleged defective product.  She is currently assisting with the completion of several depositions in preparation for trial in state court.
