Attorney Purwin-Ryan participated as a speaker/moderator in ABA’s “Presumed Defective: The Impact of the Malfunction Theory on Products Cases,” which was presented as part of the Women of the Section of Litigation’s conference. The Malfunction Theory, similar to res ipsa loquiter, allows a plaintiff to establish the existence of a product defect with circumstantial evidence supporting an inference that an unspecified defect must have caused the accident because all other possible causes are absent. A growing number of courts are embracing the malfunction theory in product liability cases. This panel of experienced trial lawyers and in-house counsel will examine how various jurisdictions are interpreting and applying the Malfunction Theory in products cases and what you need to know to properly plead it, prosecute it or defend against it.
