Cipriani & Werner’s experience with the legal issues facing the long-term care facilities industry began at “the ground floor” in the 1980s when Partner Gerald Cipriani developed and owned several assisted living homes and was responsible for the creation and maintenance of administrative policies and procedures. These activities required knowledge of not only Pennsylvania legislation, but the administrative regulations and supervisory procedures of the Pennsylvania Department of Welfare as well as other state and federal agencies that oversaw, and continue to oversee, the industry.

The continued growth of nursing homes, assisted living centers, and long-term care facilities in the region has concurrently fostered increased attention from risk managers and legal counsel with respect to professional negligence and premises liability issues. Cipriani & Werner has developed relationships with both institutional owners and insurers, providing legal counsel in workers’ compensation and casualty arenas as well as in the traditional area of negligence litigation. As a result, the firm’s attorneys in this practice group have gained years of trial experience in defending clients both in the areas of premises liability and professional liability, and are uniquely prepared and sensitive to representation of this industry.

Cipriani & Werner’s attorneys in this practice area understand that caring for the elderly and those that cannot care for themselves is a difficult, and sometimes thankless, task that is often analyzed with a critical eye by juries. The firm’s attorneys have handled cases of negligence involving the appropriateness of restraints; the level of care required for the particular resident; the quality and quantity of professional and support staffing; the quality of custodial, supervision, and medical care rendered to residents, including cases of elopement and the formation of decubitus ulcers, as well as more cases alleging intentional acts of abuse and/or abandonment.

As this region’s population continues to grow older, the long-term care facilities industry will continue to face regulatory scrutiny and claims of negligence.
