COVID-19: Georgia Supreme Court Reinstates Certain Filing Deadlines

On May 28, 2020, all pending Georgia cases may have reinstated deadlines.  For litigants, this means the number of days left to file a response as of March 14, 2020 when the first judicial emergency order was entered will resume.  Courts will be entering specific orders in each pending case to reinstate deadlines.  The deadlines for initially filing new proceedings in the Court (i.e. Appeals, etc.) are not affected.

Under the new Temporary Uniform Supreme Court Rule 11.1, litigants will have to submit a specific certificate for each response due to outline that it has been filed timely, however, a party who can show good cause for the inability to meet a deadline imposed by the Court’s rules due to problems related to COVID-19 may seek an extension of time under Uniform Supreme Court Rule 12.  Rule 11.1 will be in effect for 180 days after May 21, 2020.
