On July 24, 2014, Philip J. Sbrolla and Matthew C. Schrebe, of the Wheeling office, obtained a defense verdict in Kanawha County, Charleston, West Virginia on behalf of the firm’s client. Plaintiff hired a contractor to install the client’s product to the pool deck area of her Charleston area home. Following the installation, plaintiff alleged the product made the surface area of the pool deck slippery and unsafe. Plaintiff filed suit against both the contractor and our client alleging the product was unfit for use upon a pool deck as it created an unreasonably dangerous condition. During the four day trial, our attorneys were able to demonstrate that the contractor applied an unidentified UV topcoat overtop the client’s product and that the alleged defect was created by the topcoat.
