Robert F. Ball and Anthony Hess, attorneys in the firm’s Woodbridge (Metropolitan New York) office, successfully obtained summary judgment for a property owner from claims of negligence.
The claim involved Plaintiff who fell from the top of a trailer during a pre-trip inspection and sustained significant injuries. The property owner leased a portion of the property to Plaintiff’s employer. Attorneys Ball and Hess argued that the employer was solely responsible for maintenance in the area of the accident, that Plaintiff failed to establish that our client created any dangerous condition which caused the Plaintiff’s accident and that our client had no notice of any dangerous condition.
The Court agreed that any condition which is alleged to have caused the accident was related to the top of the employer’s trailer and that no defect or dangerous condition on the property was proven to have caused or contributed to Plaintiff’s accident.
