Robert F. Ball and Anthony Hess, attorneys in the firm’s Woodbridge, NJ (Metropolitan New York) office, successfully obtained summary judgment for a travel baseball team from claims of negligence and failure to procure required insurance.
The claim involved a batted ball which struck the plaintiff as a spectator causing significant eye injuries. Mr. Ball and Mr. Hess argued that there was no proof that any of the team’s actions were negligent and that any dangerous condition was created by the field complex owners. They further argued that a certificate of insurance which did not name the field complex owners as an additional insured was a counter offer to tournament rules and was accepted by the field owners creating new contract terms.
