Attorney Stephen H. Franko, IV, of the Scranton office of Cipriani & Werner, P.C., recently removed a client, a municipality, from liability for a premise claim by successfully arguing a Motion For Summary Judgment. The matter involved two separate lawsuits and included seven parties. Plaintiff claimed that the Municipality was responsible for a “hazardous condition”, arising when a tree allegedly caused a defect in the sidewalk where the plaintiff tripped causing Plaintiff’s injuries.
Initially, Attorney Franko obtained a court order, which led to the dismissal of three parties, the consolidation of the related companion case, and then Franko aggressively fought the remaining parties’ claims on behalf of the Municipality.
The client was extremely pleased with the outcome, as Attorney Franko’s attention to detail and thorough research and knowledge of the law saved the client thousands of dollars and dismissed them from suit. Cipriani & Werner, P.C., attorneys are proud of their reputation for early assessment attention to detail, and aggressive representation.
