Lois M. Shenk, a partner in Cipriani & Werner’s Philadelphia office, recently secured a unanimous defense verdict in a (5) day jury trial in Bucks County, Pennsylvania in a case involving claims of defamation and intentional interference with a contract and punitive damages.

The plaintiff was attempting to sell his condominium and the potential buyer applied for a mortgage.  In addition to owning one of the condos, the plaintiff was also the builder of the condos.  There were on-going negotiations between the builder and the condominium owners’ association about a construction punch list and litigation over the punch list was contemplated.

In that context, defendant condominium owners’ association, as required by banking laws and condominium laws, provided information to banks concerning the mortgage application of the potential buyer of plaintiff’s condo.  Through the testimony of multiple defense witnesses and cross examination of the plaintiff, Attorney Shenk was able to show that any statements (written and oral) made by the defendant to the banks were truthful and therefore, a complete defense to all the allegations.
