Marc Jones, Esquire, of Cipriani & Werner’s New Jersey office, secured a defense verdict in an insurance coverage trial victory in Ocean County Superior Court.
The case involved a seriously injured guest passenger who claimed UIM benefits under the host vehicle's commercial auto policy. Cipriani & Werner intervened in the underlying suit on behalf of the commercial auto insurer to defend the UIM claim and to dispute the plaintiff's entitlement to coverage. Summary judgment was attempted and denied because of credibility issues and questions of fact. The case proceeded to a bench trial.
The stakes were high given the alleged injuries and surgery, and high commercial policy limits. After a full day of testimony from the plaintiff, the named insured, and other witnesses, the court ruled that, based on the evidence presented at trial, the plaintiff was not entitled to UIM benefits under the insurance company’s commercial auto policy.
