Attorneys Andrew Foulkrod and Eric Lauerman, members of the Medical Malpractice team in the firm's Harrisburg office, prevailed at trial in the defense of a local otolaryngologist. It was alleged that the otolaryngologist was negligent in performing uvulopalatalpharyngoplasty (UPPP) in an outpatient surgical center on a 23 year old woman with severe obstructive sleep apnea. The patient suffered fulminant post obstructive pulmonary edema from which she could not be resuscitated. It was alleged that a hospital environment would have been better equipped to handle complications associated with severe obstructive sleep apnea, and also that failure of CPAP treatment was a necessary prerequisite to offering a surgical option in the first place.
