Robert A. Lockhart, a partner in the firm's Charleston office, recently received a defense verdict for the firm's client, Ohio Bath Solutions, in a jury trial in Wayne County, West Virginia.
The case involved a bathtub liner installed by Ohio Bath Solutions (Bath Fitter) in the Plaintiff's home. The Plaintiff alleged that stagnant water trapped beneath the liner caused an infection which ultimately led to the amputation of his little toe and part of his foot. The Plaintiff also alleged that, as a result of water under the liner, he fell and sustained neck and back injuries. The Plaintiff's medical expenses exceeded $140,000.
After a two day trial and less than two hours of deliberations, the jury returned a verdict of $34,000 and finding Plaintiff 50% at fault, barring any recovery from Ohio Bath Solutions.
