Mullins and Marston Secure Unanimous Defense Verdict in Business Fraud and Conspiracy Jury Trial

Alison R. Mullins, a partner in Cipriani & Werner’s Fairfax, Virginia office, and Luke Q. Marston, an associate in the Fairfax office, recently secured a unanimous defense verdict in an eight (8) day jury trial in Fairfax County in a case involving a $50+ million-dollar claim for fraud in the inducement and conspiracy.

The Plaintiffs brought suit against six defendants, including the seller of the business, various in-house staff, and the business broker and brokerage regarding the alleged fraudulent sale of a medical supply business.  Attorneys Mullins and Marston represented the business brokerage for the seller of the business in the transaction, and the broker himself.  Plaintiffs alleged that the business brokerage and broker were deeply involved in the creation, alteration, and transmission of fraudulent financials which induced Plaintiff into purchasing the business.

Ms. Mullins and Mr. Marston, through cross-examination of Plaintiff, direct testimony of the clients, and ample documentary evidence, crafted a cohesive narrative that demonstrated their clients’ lack of affirmative misrepresentations, Plaintiffs’ inability to rely upon transmitted documentation, and lack of liability to Plaintiff.

While Plaintiffs ultimately obtained a favorable jury verdict against the other defendants, Cipriani & Werner’s client was found not liable as to all claims against them.
