David E. Heisler, of the Scranton office of Cipriani & Werner, successfully defended a casino that was sued for allegedly allowing its valet service to hand the keys of a car over to its visibly intoxicated owner upon his request at the trial court level and subsequently with the Superior Court. Faced with an issue of first impression in this Commonwealth regarding the duty and ultimate liability of a valet service when an automobile is returned to an allegedly intoxicated person, the Superior Court found that no such duty exists under Pennsylvania law. The court affirmed the dismissal of the lawsuit.
